Terms of Service – PandaCare

Welcome to PandaCare. These Terms of Service (“Terms”) govern your use of the PandaCare mobile application and related services (“Service”) operated from Canada. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. Acceptance
By creating an account, starting the 14-day free trial, or otherwise using PandaCare, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance of the updated Terms.
2. Description of the Service
PandaCare is a health and wellness companion app that offers daily check-ins, personalized suggestions (e.g. movement, hydration, mindfulness), progress tracking, and optional subscription features. The Service is for general wellness support only and is not a substitute for professional medical, mental health, or nutritional advice.
3. Account and Eligibility
You may use the Service as a guest or create an account. You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and notify us of any unauthorized use. You may request account deletion from Profile settings where available; additional details are described in our Privacy Policy.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: misuse or attempt to gain unauthorized access to the Service or others’ accounts; transmit harmful, offensive, or illegal content; reverse-engineer or interfere with the Service; or use the Service in any way that could harm PandaCare, other users, or third parties. We may suspend or terminate access for violation of these terms.
5. Subscription, Free Trial, and Payment
Certain features are available by subscription. New accounts include a 14-day free trial with full access to the Service. After the trial ends, continued access to those features requires an active subscription. The introductory price is US $3.99/month as an offer for early users; Apple and Google set the price you pay in your region and currency, and the exact amount is shown in the store before you purchase or subscribe. Subscription fees are charged through the Apple App Store or Google Play Store in accordance with their respective terms. Prices and billing cycles are also summarized in the app where applicable. You may cancel a subscription through your device’s store settings; refunds are subject to the store’s policies. We do not store your full payment card details.
6. Health and Wellness Disclaimer
The content and suggestions in PandaCare are for general wellness and informational purposes only. They are not medical, psychological, or nutritional advice and do not replace consultation with qualified professionals. Always seek the advice of your physician or other qualified health provider with any questions about a medical or mental health condition. Do not disregard professional advice or delay seeking it because of something you read or received in the app.
7. Limitation of Liability
To the fullest extent permitted by applicable law, PandaCare and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use or inability to use the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum permitted by law.
8. Changes to the Service and Terms
We may modify, suspend, or discontinue the Service or any part of it at any time, including analytics or optional feature integrations (such as step tracking or food-image analysis). We may also update these Terms; we will indicate the “Last updated” date when we do. Your continued use of the Service after changes constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service.
